1. Acceptance of Terms

By accessing or using the PayForge website and services ("Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not access or use our Services. These Terms constitute a legally binding agreement between you and PayForge Ltd.

2. Description of Services

PayForge provides payment infrastructure solutions for iGaming, betting, and high-risk vertical operators. Our services include, but are not limited to:

  • Multi-MID acquiring and transaction processing.
  • Cascading routing and intelligent payment optimization.
  • Chargeback control and fraud prevention tools.
  • Real-time analytics and reporting dashboards.

3. Eligibility

Our Services are available only to businesses and individuals who are at least 18 years of age and have the legal capacity to enter into binding agreements. By using our Services, you represent and warrant that you meet these eligibility requirements and that your use of our Services complies with all applicable laws and regulations in your jurisdiction.

4. Account Registration

To access certain features of our Services, you may be required to register for an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Maintain the security of your account credentials.
  • Accept responsibility for all activity that occurs under your account.
  • Notify us immediately of any unauthorized use of your account.

5. Prohibited Activities

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws.
  • Process transactions related to illegal activities, terrorism financing, or money laundering.
  • Attempt to gain unauthorized access to our systems, networks, or data.
  • Interfere with or disrupt the integrity or performance of our Services.
  • Reverse-engineer, decompile, or disassemble any aspect of our technology.
  • Use the Services to transmit harmful code, malware, or engage in phishing activities.

6. Fees and Payment

Fees for our Services are outlined in the applicable service agreement executed between PayForge and each partner. PayForge reserves the right to modify fee structures with 30 days' prior written notice. All fees are non-refundable except as expressly stated in the service agreement.

7. Intellectual Property

All content, trademarks, logos, designs, and intellectual property displayed on the PayForge website and within our Services are the exclusive property of PayForge Ltd. or its licensors. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law, PayForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use our Services.

9. Indemnification

You agree to indemnify, defend, and hold harmless PayForge, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Services or your violation of these Terms.

10. Termination

PayForge reserves the right to suspend or terminate your access to the Services at any time, with or without cause and with or without notice, if we believe you have violated these Terms or if required by law. Upon termination, your right to use the Services will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Union of Comoros, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Union of Comoros.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the revised Terms on our website. Your continued use of the Services after such changes constitutes acceptance of the modified Terms.
